Introduction

Househappy, Inc. ("Househappy" or "We") respect your privacy and are committed to protecting it through our compliance with this policy.

This privacy policy (the “Privacy Policy”) explains the collection, use, and disclosure practices of the websites, mobile applications, and other online and offline products and services (collectively, the “Services”) owned and operated by Househappy, Inc. This Privacy Policy also describes how we collect and use information when you access and use our websites (the “Site”). Please be advised that the practices described in this Privacy Policy also apply to information that you submit to us offline and to Personal Information (as described below) that we may collect from third parties. By using our Site or submitting information to us, you acknowledge and understand the terms of our Privacy Policy and are giving express consent to our Terms of Service. Collection & Use of Your Personal Information

As used in this Privacy Policy, “Personal Information” means any information that identifies, relates to, describes, is reasonably capable of being associated with, reasonably can be linked, directly or indirectly, with an individual or household, or as otherwise defined under applicable law.

You also may provide information to be published or displayed (hereinafter, "posted") on public areas of the Services, or transmitted to other users of the Services or third parties (collectively, "User Contributions"). Your User Contributions are posted on and transmitted to others at your own risk. Although you may set certain privacy settings for such information by logging into your account profile, please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of other users of the Services with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.

Information We Automatically Collect from Your Use of the Site

As you navigate through and interact with our Website, we may use automatic data collection technologies, such as cookies, web beacons, and analytics tools to collect certain information about your equipment, browsing actions, and patterns, including:

The technologies we use for this automatic data collection may include:

  • Cookies (or browser cookies).A cookie is a small file placed on the hard drive of your computer. You may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting you may be unable to access certain parts of our Website. Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you direct your browser to our Website.
  • Web Beacons.Pages of our the Website and our e-mails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit Househappy, for example, to count users who have visited those pages or opened an email and for other related website statistics (for example, recording the popularity of certain website content and verifying system and server integrity).
  • Analytics.We use a tool called "Google Analytics" to collect information about use of the Website. Google Analytics collects information such as how often users visit the Website, what pages they visit when they do so, and what other sites they used prior to coming to the Website. We use the information we get from Google Analytics only to improve the Website. Google Analytics collects only the IP address assigned to you on the date you visit the Website, rather than your name or other identifying information. Although Google Analytics plants a permanent cookie on your web browser to identify you as a unique user the next time you visit the Website, the cookie cannot be used by anyone but Google. Google's ability to use and share information collected by Google Analytics about your visits to this site is restricted by the Google Analytics Terms of Use and the Google Privacy Policy. You can prevent Google Analytics from recognizing you on return visits to this site by disabling cookies on your browser.

How We Use Your Information

We use information that we collect about you or that you provide to us, including any personal information, for the business and commercial purposes below:

  • To inform your sponsor about the services you may need, the services you order, and the particular information about your home relevant to those services so that the sponsor can improve the services it provides to you and its other customers.
  • To allow you to participate in interactive features through the Services.
  • Offer and administer surveys, contests, prize draws, sweepstakes, and other promotions.
  • Conduct internal research and development.
  • Detect security incidents and protect against malicious, deceptive, or illegal activity, including fraudulent transactions, error, negligence, and breach of contract, and to protect against harm to the rights, property, or safety of us and our users, customers, employees, or the public.
  • Debug, identify, and repair errors that impair the functionality of our Services.

Disclosure of Your Information

We may share aggregated, anonymous, or de-identified information to our advertisers, business partners, and other third parties that cannot reasonably be used by those third parties to identify you.

We may disclose personal information that we collect or you provide as described as follows:

  • To our subsidiaries and affiliates, including our investors.
  • To contractors, service providers, Account Sponsors, and other third parties we use to support our business and who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them. This disclosure may include notifying the third party who purchased our products for you on your behalf (for instance, your sponsor ) about when and how you have used the products, the particular services you have ordered through them, and the answers you have provided us regarding the particular facts about your home that are relevant to such services.
  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Househappy, Inc.’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by Househappy, Inc. about users of our Services is among the assets transferred.
  • We may share aggregated, anonymous, or de-identified information to our advertisers, business partners, and other third parties that cannot reasonably be used by those third parties to identify you.
  • We may disclose your information to third parties for whom you have given us authorization or consent to make such disclosure.

  • To enforce or apply our terms of use and other agreements, including for billing and collection purposes.
  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Househappy, our customers, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.

Choices About How We Use and Disclose Your Information

We strive to provide you with choices regarding the personal information you provide to us. We have created mechanisms to provide you with the following control over your information. For example, you may receive Promotional Offers from Househappy.

If you do not wish to have your contact information used by Househappy to promote our own or third parties' products or services, you can opt-out by sending us an email stating your request to support@househappy.com. If we have sent you a promotional email, you may send us a return email asking to be omitted from future email distributions. This opt out does not apply to information provided to Househappy as a result of a product purchase, warranty registration, product service experience or other transactions.

You have the right to submit a complaint or to object to the collection and use of your information by us at any time or to require us to review, transmit, change, or delete your information that we have collected and retained. We will respond to your request to exercise any of these rights after receiving a complete request, with the exception of information that is needed to complete the transaction for which the Personal Information was collected, to provide the information you have requested from us, as allowed or authorized by law, or that is reasonably anticipated within the context of our ongoing business relationship with you. If you delete your User Contributions from the Services, copies of your User Contributions may remain viewable in cached and archived pages or might have been copied or stored by other Services users. Proper access and use of information provided through the Services, including User Contributions, is governed by our terms of use.

Data Security

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. All information you provide to us is stored on secure servers behind firewalls. Any payment transactions will be encrypted using SSL technology.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of the Services, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas of the Services like message boards. The information you share in public areas may be viewed by any user of the Services.

Children Under the Age of 16

The Services are not intended for children under 16 years of age. No one under age 16 may provide any information to or through the Services. We do not knowingly collect personal information from children under 16. If you are under 16, do not use or provide any information through the Services, including registering to use the Services, making any purchases through the Services, and using any of the Services’ interactive or public comment features. If we learn we have collected or received personal information from a child under 16 without verification of parental consent, we will delete that information. If you are a California resident, California law may provide you with additional rights regarding our use of your personal information.

This Privacy Notice for California Residents supplements the information contained in our Privacy Policy and applies solely to all visitors, users, and others who reside in the State of California (“consumers” or “you”). We adopt this notice to comply with the California Consumer Privacy Act of 2018 (CCPA), as amended, and any terms defined in the CCPA have the same meaning when used in this notice. In the preceding twelve (12) months, we disclosed, and will continue to disclose, the categories of Personal Information listed above for a business purpose. We may disclose the Personal Information to the following categories of third parties for a business purpose:

  • Non-affiliated third parties, with your prior consent.

In the preceding twelve (12) months, we have not sold or shared Personal Information. We do not sell or share Personal Information.

Retention Periods

Due to the breadth and variety of data collected by us, it is not possible for us to provide you with a comprehensive list of timeframes during which we retain each category of Personal Information. We retain categories of information as reasonably necessary to satisfy the purpose for which we collect the information. This time period varies depending on the purpose for which we collected the information, the nature and frequency of our interactions and relationship with you, whether we have a legal basis to continue retaining the information, industry practices, the value and sensitivity of the information, and state and federal recordkeeping requirements.

Personal Information of Minors

We do not knowingly collect the Personal Information of minors. We do not sell or share the information of consumers under 16 years of age.

Sensitive Personal Information

We do not use or disclose sensitive Personal Information for any purposes other than those specified in the CCPA.

Your Rights and Choices under the CCPA

The CCPA provides California residents with specific rights regarding their Personal Information. This section describes your CCPA rights and explains how to exercise those rights.

Access to Specific Information and Data Portability Rights

You have the right to request that we provide certain information to you about our collection and use of your Personal Information over the past 12 months. Once we receive and confirm your verifiable consumer request, you have the Right to Know:

Deletion Request Rights

Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your Personal Information from our records, unless an exception applies.

You have the right to correct Personal Information you believe to be inaccurate.

We will not discriminate against you for exercising any of your CCPA rights.

Exercising Access, Data Portability, Deletion, and Correction Rights

Only you, or someone legally authorized to act on your behalf such as an authorized agent, may make a verifiable consumer request related to your Personal Information. You may also make a verifiable consumer request on behalf of your minor child. The CCPA allows a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Information.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with Personal Information if we cannot verify your identity or authority to make the request and confirm the Personal Information relates to you. Making a verifiable consumer request does not require you to create an account with us. We will only use Personal Information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

You may use an authorized agent to submit a request. Authorized agent requests will be processes like any other request, but we will also require you to provide the agent’s written permission to make the request and verify the agent’s identity with us.
